Company file — Choice Home Warranty

Choice Home Warranty claims, decoded: caps, clauses, and the denials they're known for

The second giant — the company whose own agreement (§E.5) says it can demand your maintenance records when it reviews your denial. The records company.

The basics

Waiting period: 30 days before coverage starts
Service fee (per claim visit): Amount set in customer's Coverage Details (not a single published figure in the agreement); independent reviewers report $85-$100 per service request
Workmanship guarantee: 30 days
Cancellation: Customer may cancel at any time for any reason (Section H.2). Within first 30 days of Order Date: repayment of paid Agreement Fee less any Service Costs incurred (unless prohibited by law). After 30 days: pro-rata repayment for unexpired term less Service Costs, plus an administrative fee of the lesser of $50 or the amount permitted by law; if Service Costs exceed the repayment, customer owes the difference (capped as stated in H.2.b). Company may cancel only for nonpayment of Agreement/Service Fee, fraud/misrepresentation, or mutual agreement (H.1).

The public record

BBB rating: B (not BBB accredited, per Insurify 2026) · Complaints on file: Over 9,000 complaints in the past three years (ConsumersAdvocate company-details page, data collected 2025; page updated Sep-Oct 2026). Prior brief's '11,000+ BBB complaints/3yrs' was NOT re-verified to an exact figure this pass - treat 9,000+ as the sourced floor. (read 2026-10-18)
The BBB profile

Complaint counts are a record of volume, not a denial rate — no company publishes one, and we don't invent one.

The clauses that decide claims

Pre-existing conditions

Systems 'must be in proper working order on the effective date of this home warranty Agreement. Known or unknown pre-existing conditions are not covered.' - stricter than AHS/First American/Cinch: UNKNOWN pre-existing conditions are also excluded.

Section A.2

Can they demand your maintenance records?

VERIFIED as briefed: 'In the event coverage is denied, and [you] seek to have Us review that denial, We have the right to request routine maintenance records and/or home inspection reports in reviewing Our decision.' Agreement also excludes routine maintenance and malfunction due to misuse, abuse or neglect; only normal wear and tear failures are covered.

Section E.5

Repair, replace — or a check

VERIFIED: 'We have the sole right to determine whether a Covered Item will be repaired or Replaced... We reserve the right to offer cash or cash equivalent in lieu of repair or Replacement in the amount of Our actual cost (which at times may be less than retail) to repair or Replace any Covered Item. Cash or cash equivalent offered in lieu of repair or Replacement does not include the costs of shipping, tax, or installation.' After a cash-for-replacement payment, no further claims on that item for 12 months.

Section E.3

Hiring your own contractor

'We will not reimburse for services performed without prior approval' and 'We have the sole right to select the Service Provider.'

Section B.3 and Section B.6

If you fight: how disputes work

Mandatory binding arbitration administered by the American Arbitration Association (AAA Commercial or Consumer Rules), individual capacity only, with a class action waiver; mediation step first (written claim + 30 days for company to respond). Choice of law: New Jersey; proceedings in New Jersey unless prohibited by law.

Section I (Resolution of Disputes - Mandatory Arbitration), incl. I.2 AAA, I.3 Class Action Waiver, I.5 Choice of Law/Venue (NJ)

The denials Choice Home Warranty is known for

  • Pre-existing condition - known OR unknown; item not in proper working order on effective date — contract clause
  • Not normal wear and tear - misuse, abuse, neglect, or lack of routine maintenance; company may demand maintenance records / home inspection reports when customer asks it to review a denial — contract clause
  • Cash-in-lieu buyout at company's own actual cost (below retail), excluding shipping, tax and installation, instead of repair/replacement — contract clause
  • Misrepresented coverage and failure/refusal to replace AC units and appliances advertised as covered; denial of an AC compressor claim a contractor diagnosed as normal wear and tear — AG action
  • Access and sub-item caps bite: $500 access limit and $250-$500 caps on well pump, roof leak, septic, sprinkler, ice maker, trash compactor leave most of a real repair bill unpaid — contract clause

Run your own situation through the readiness checker — it uses this company's caps and clauses. Already denied? The denial decoder starts with the reason on your letter.

Be ready before it breaks — and fight it right if they say no

Included in the $39 WarrantyDecoded Kit

  • The evidence-file system — the day-one baseline file (photos, serial numbers, inspection report) that makes 'pre-existing' hard to claim
  • Maintenance logs organized by denial reason — each log page names the denial it defeats ('not maintained' dies when the records exist)
  • The claim-call script — what to say when you call a claim in, and the things to never say on a recorded line
  • The denial-appeal ladder — written appeal, escalation, your state's correct complaint door, and the arbitration/small-claims routing your contract actually allows
  • The cash-out worksheet — their 'actual cost' check vs. the real replacement price, so you know the gap before you accept it
  • The renew-or-cancel worksheet — caps against the replacement cost of YOUR oldest systems, with the numbers filled in
